1. Definitions

In these terms and conditions:

Provider: The Muscle Factory.

User: any natural person using the fitness app.

App: the digital fitness application including all features, workouts and content.

2. Applicability

These terms and conditions apply to all use of the fitness app and all agreements between The Muscle Factory and the User.

3. Use of the App

Use of the app is entirely at the User’s own risk.

The app is intended to support fitness and training purposes and does not replace medical advice.

The User declares to be physically fit to participate in physical activities.

4. Liability

The Muscle Factory, management and staff shall not be liable for any injury, damage, loss or theft, direct or indirect, resulting from the use of the app or facilities.

Participation in workouts, exercises and programs is entirely at the User’s own responsibility.

The Muscle Factory is not liable for technical failures, data loss or temporary unavailability of the app.

5. Payment and Subscriptions

Payments are processed via swipe or cash.
Subscriptions renew automatically unless cancelled in time.

Paid amounts are non-refundable unless required by law.

6. Intellectual Property

All content within the app, including workouts, schedules, texts and images, remains the property of The Muscle Factory and may not be copied or distributed without written permission.

7. Privacy

Personal data is processed in accordance with the applicable privacy laws of Curaçao. By using the app, the User agrees to this processing.

8. Termination

The Muscle Factory reserves the right to terminate access to the app in case of misuse or violation of these terms.

9. Governing Law

This agreement is governed exclusively by the laws of Curaçao.
Any disputes shall be submitted to the competent court in Curaçao.
